To provide a fair and equal chance of winning to all readers, the following are the official rules for all contests of Gizmodo Media Group, LLC’s websites (“GMG”) unless otherwise stated and/or posted (effective March 17, 2017).
1. Eligibility and Applicability of Guidelines
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT IMPROVE CHANCE OF WINNING.
Open to US residents only. All entrants must be 18 years of age or older, unless otherwise stated and/or posted. GMG management, employees and their families are prohibited from entering. All entrants agree to be bound by (i) GMG’s contest guidelines, whether contained herein or within each contest’s specific posted guidelines, and (ii) the decisions of GMG regarding validity of participation and selection of winners, which shall be final and binding in all respects. All federal, state, and local rules and regulations apply and will supersede any conflicting guideline contained herein or within each contest’s specific posted guidelines. GMG reserves the right to alter any rules of any contest at any time. In all instances, GMG contests and contest guidelines are void where prohibited by law.
2. Contest Entry
Entrants must submit entries using the specific entry information contained in the contest announcement post, including the correct contest entry email address and subject line if applicable.
In addition to any electronic means of submission, entrants may mail entries to Gizmodo Media Group, LLC, Attn: Contests, 114 Fifth Avenue, 2nd Floor, New York, NY, 10011. Mailed entries must include a subject line containing the contest name, a valid email and/or postal address, a phone number where the entrant may be reached, and any other specific entry information requested in the contest announcement. Mailed entries are subject to the same entry period, rules, and chance to win as entries submitted electronically or otherwise.
GMG is not responsible for and will not consider incomplete or incorrect contest entries, entries that are late, lost, destroyed, or misdirected, or entries sent but not received by GMG for any reason, as potential contest winners.
Unless otherwise specified in an individual contest post, GMG will only consider one entry per email address (if entry is emailed), postal address (if entry is mailed), Kinja username (if entry is submitted by posting a comment), or social media account (if entry is submitted via social media platform). No entrant may enter any contest more than once using multiple means of entry and/or multiple email addresses, postal addresses, usernames, or Twitter handles, unless otherwise specified in the individual contest post. Any attempt by an entrant to submit more than the permissible number of entries by using multiple/different email addresses, identities, registrations, logins, or any other methods may void that entrant’s submitted entries and that entrant may be disqualified. GMG reserves the right to cancel, suspend or modify the contest where necessary. GMG may discontinue any contest if there is evidence of malfeasance, hacking, misuse, security breaches, or other tampering, and shall not be liable for damages arising from such circumstances.
3. Conditions for Submission of Content to GMG Contests
Unless otherwise proscribed by law, by submitting any content to GMG, including text, audio, video, photo, or other content (“Entry Content”) as part of your participation in a GMG contest:
You hereby grant to GMG and its affiliates, subsidiaries, licensees and assigns, an irrevocable, perpetual, freely sublicensable and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish and otherwise make use of the submitted Entry Content in any and all media, whether now known or hereinafter created, throughout the world and for any purpose. The rights granted to GMG include but are not limited to the right to resize, crop, censor, compress, edit, feature, caption, affix logos to, and otherwise alter or make use of the submitted Entry Content;
You hereby represent and warrant (i) that the Entry Content does not and shall not infringe on any copyright, any rights of privacy or publicity, or any other right of any third party, and (ii) that you have the right to grant any and all rights and licenses granted to GMG herein, including but not limited to all necessary rights under copyright, free and clear of any claims or encumbrances;
You acknowledge and agree that GMG shall have no obligation to post, display or otherwise make publicly available any Entry Content submitted by you, and may, in its sole and unfettered discretion, remove, edit, modify or delete any Entry Content that you submit to GMG;
You understand and intend that any Entry Content submitted by you to GMG may be available for viewing, rating, review and comment on by the public, and understand that comments or ratings which you dislike or with which you disagree may be published or otherwise become associated with any Entry Content you submit to GMG. By submitting any Entry Content to GMG, you hereby waive any privacy expectations that you may have with respect to any such Entry Content submitted by you to GMG;
You hereby agree to hold GMG and its directors, officers, employees, affiliated entities, agents, contractors, insurers, advertisers, sponsors, licensees, and assignees (the “GMG Parties”) harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any GMG site, or any other use authorized under these Terms, of any Entry Content submitted to GMG by you; and
You acknowledge that Entry Content submitted by you shall be the property of GMG, and GMG shall have no obligation to preserve, return or otherwise make available to you or others any Entry Content so submitted.
4. Selection and Notification of Winners; Waiver by Winners; Prizes Awarded
Unless otherwise prohibited, in addition to the terms set forth elsewhere in these Contest Guidelines, by entering a GMG contest, each entrant:
Agrees to waive and release the GMG Parties from any claim arising from participation in the contest and/or acceptance or usage of the winning prize;
Agrees to hold harmless the GMG Parties for any and all damages that may result from participation in the contest and/or acceptance or usage of the winning prize;
Acknowledges that none of the GMG Parties shall be liable for any warranty, costs, damage, injury, or any other claims incurred as a result of the usage of any prize once the winner has taken possession of the prize; and
Agrees to GMG’s use of the entrant’s name, likeness, voice, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
Winners of “random email” or “random comment” contests will be chosen by GMG at random from emails received and/or comments posted. The odds of winning a “random email” or “random comment” contest will depend on the number of entries received.
“Best of” contests and any other contests requiring entrants to submit Entry Content (defined in Section 3, above) will be judged entirely at the discretion of GMG.
Where possible, contest winners will be contacted and notified by the same means by which the participant entered the contest, i.e., the “sender” email address used to enter the contest, the email address associated with the username used to submit a contest entry via comment, the return postal address from where the winning entry was mailed (unless the mailed entry requests alternative notification by electronic means), or the social media account from which the winning entry was submitted via social media platform. GMG will consider the person who replies to the notification to be the winner.
In order to claim a prize, GMG must receive a reply from the selected contest winner containing all requested information within 7 days of the date of the first win notification sent by GMG (whether by email, mail, phone, social media message, or comment) to the contest winner. Any contest winner’s failure to respond to a win notification within the allotted time period shall mean that the winner has forfeited the prize, and that GMG shall cease to have any obligation to that entrant. GMG is not required to award elsewhere any prizes forfeited by its originally selected winner(s).
In order to be awarded a prize upon receipt of a win notification, each contest winner must supply GMG with his/her legal name, mailing address, birth date, and any other contact information GMG deems necessary. For some contests, prizewinners may be required to provide to GMG legal proof of identity and social security number within 7 days of notification of winning the prize. A winner may forfeit any and all prizes if the winner fails to provide GMG with the required contact information and/or identity and social security number verification within 7 days. Where appropriate, GMG will mail any prize to the address supplied by the recipient of the notification. Where delivery of the prize cannot reasonably be accomplished through mail, GMG will arrange with the winner the manner by which the prize will be awarded.
Winners are solely responsible for any taxes and/or fees, and all such additional costs that may be incurred as a result of the receipt of a prize.
GMG will not substitute any prize unless the specified prize becomes unavailable due to unforeseen circumstances, in which case GMG may substitute a prize at its sole discretion of like or equal value. Winners shall not be entitled to transfers or substitutions of a prize for cash or otherwise.
For a list of contest winner names, mail a letter specifying the contest you are inquiring about and include a self-addressed and prepaid envelope to Gizmodo Media Group, LLC, Attn: Winner List, 114 Fifth Avenue, 2nd Floor, New York, NY, 10011.
